Has Procedural Fairness Gone Too Far? The balance between an enforceable award and an efficient process.

Procedural fairness and efficiency are both cornerstones of arbitration, but they are often competing objectives that require a delicate balance.  While fairness requires giving each party a reasonable opportunity to present its case, efficiency aims to resolve disputes quickly and efficiently with the aim of preventing excessive delays and costs. This panel will provide a lively debate between arbitrators and arbitration counsel on the extent to which the competing objectives of procedural fairness and efficiency have fallen out of balance in modern arbitral practice, and the ways in which that balance can be recaptured.
